Impure Water: The Difference between a Small and Large Quantity

Salaam. What renders water impure when in small quantity or large/flowing etc. JazakAllah Kahir.

Answer:

Wa alaykum salam wa rahmatuLlahi wa barakatuHu,

In Mughni al-Muhtaj v. 1, p. 50, Khatib Shirbini mentioned that if a large amount of water would come into contact with an impurity and not change, then it would not become impure. And if it would change due to coming into contact with the impurity, then he related an ijma’ [scholarly consensus] that the water is impure.

On Keeping the Beard

Question:

Salam

I’ve had people recently asking me the ruling for shaving the beard in accordance to my understanding all four schools of thoughts had a consensus that shaving is haram however I have read recently that the relied-upon position for the Shafii Madhab is that it is makrooh (not sinful) to shave the beard is this correct?

If yes, then the fact that this is a sign of islam to keep a beard how can i explain to those who pick and chose from different schools of thought or if someone is [following] the Shafii Madhab How do i tell them that they should still grow it and not consider it a small act to shave? If there is no way then that is understandable

Also, i dont know the terminologies in the shafii madhab when it comes to makrooh so is someone shaves and never grows a beard in accordance to the shafii madhab will he ever be considered a sinner.

Clarification on removing the taste of najasah

Question:

Assalamu alaikum wa rahmatullahi wa barakatuh,

In “Reliance of the Traveler” in the section “Washing away filth”, the sheikh (rahimuhu Allah) says: “But if it is a substance (with discernible characteristics, i.e. najasa ‘ayniyya) it is obligatory to remove all taste of it, even if difficult, and to remove both color and odor if not difficult.

Could you please clarify the obligation to remove all taste of najasah ‘ainiyyah

‘A’ishah’s Hadith on Kissing, For Wudu’ or Fasting?

Question:

Assalamu’alaikum warahmatullahi wabarakatuhu,

Dear Shafii Fiqh Team, I have a question regarding the quality of the following hadits:

عَنْ عَائِشَةَ , أَنَّهَا بَلَغَهَا قَوْلُ ابْنِ عُمَرَ: فِي الْقُبْلَةِ الْوُضُوءُ , فَقَالَتْ: كَانَ رَسُول اللَّهِ صَلَّى اللهُ عَلَيْه وَسَلَّمَ «يُقَبِّلُ وَهُوَ صَائِمٌ ثُمَّ لَا يَتَوَضَّأُ» . وَلَا أَعْلَمُ حَدَّثَ بِهِ عَنْ عَاصِمِ بْنِ عَلِيٍّ هَكَذَا غَيْرُ عَلِيِّ بْنِ عَبْدِ الْعَزِيزِ

This hadits was narrated by Imam Daruquthni rahimahullah. I already search in the maktabah syamilah but found no where the quality of the hadits from shafii scholars. Jazakallahu khairan katsira for your help.

In al-Sunan al-Kubra v. 1, p. 125, Imam Bayhaqi mentioned,

والحديث الصحيح عن عائشة في قبلة الصائم فحمله الضعفاء من الرواة على ترك الوضوء منها ولو صح إسناده لقلنا به إن شاء الله تعالى

“[Regarding] the well-authenticated hadith on the authority of ‘A’ishah regarding the kissing of one fasting, weak narrators mistransmitted it as not performing ablution on account of it; if there was a sahih isnad for it, we would maintain it insha’Allah.”

Wudu and the Qur’an on an E-Reader

Question:

As Salaamu alaikum,

I recently purchased an e-reader for reading books, including the Quran.  But it occurred to me that I sometimes will not have wudu while carrying it.  How should one treat the Quran in electronic format?

Wa alaykum salam wa rahmatuLlahi wa barakatuHu,

The Shafiyyah discuss the issue of a lawh [a slate upon which the Qur’an is written for study]. Regarding this, in Kifayat al-Nabih v. 1, p. 434, Ibn al-Rif’ah related two opinions; the relied-upon, which is stated in Qadi Husayn’s Ta’liq, al-Tahdhib, Imam al-Haramayn’s Nihayah, and al-Kafi, is that it is unlawful to touch it without ablution. In Rawdah v. 1, p. 239, Imam Nawawi asserted this opinion without mentioning a difference. In Sharh al-Muhadhdhab v. 2, p. 69, he mentioned two opinions. The relied-upon is ascribed to the majority of the As-hab as “al-Madhhab al-Sahih.” In short, the relied-upon opinion is that touching it requires ablution.

The ruling extends here as the digitally displayed text, on electronic paper for example, is written and we consider it as Qur’an. Thus, if one is holding an e-reader to read the Qur’an from it, then ablution is necessary.

When the e-reader is off, for example, and the Qur’an is merely preserved in the system’s memory along with other books, then this would not require ablution.

Purifying From Pre-ejaculatory Fluid at Work

Question:

Assalamualaikum, it is my understanding that one must do ghusl (obligatory bath) if one secretes semen. But ghusl is not required for pre-cum. Still one must change the article of clothing? If this is the case, then what if an individual is out i.e. at work, and is not in a position to do so? Can he pray the fard prayers? Keeping that he cleans his private parts and slightly washes the article of clothing also? Is the prayer accepted?

Wa alaykum salam wa rahmatuLlahi wa barakatuHu,

In Sharh al-Muhadhdhab v. 2, p. 552, Imam Nawawi related that there is an ijma’ [consensus] established that madhi is an impurity. While, it is an impurity which one can purify from. In our School, it is necessary that it be washed and merely splashing water on it does not suffice. We base this understanding on the hadith wherein washing is specified, “He washes his private and performs ablution. Yaghsilu dhakarahu wa yatawadda’u.” (Sahih Muslim v. 3, p. 557) Additionally, we find the ruling to analogously correspond to that of other impurities.

The Issue of wiping over a cast

 

Question:

assalam. I had a fall last weekend and fractured my lower arm bone,and doctor prescribed “cement” over the injured arm for next 5 weeks. Water cannot run over that part of my arm. How do I validate wudhu? Do I have to perform qadho prayers for the following 5 weeks if my prayers now not valid? I am happy if you have already answered such ?’s before. Pls respond ASAP. Wassalam.

Wa alaykum salam wa rahmatuLlah wa barakatuHu,

Regarding having a broken wrist that necessitates a cast for a few weeks and is not possible to take off, it is necessary that it be put on while in a state of purity. If one did not do so; then, if possible it is necessary that it be removed, one purifies, and then reapplies it while pure. If removing it will cause harm, then one does not need to do so, wiping on it will be valid. (Sharh al-Muhadhdhab v. 2, p. 315-21)
